Digital Plan Licensing Agreement

This Digital Plan Licensing Agreement (“Agreement”) governs the purchase and use of digital architectural plans, drawings, and related design documents (“Plans”) provided by Pionarch Design & Construction (“Pionarch”).
By purchasing, downloading, accessing, or using any Plans from Pionarch, you agree to the terms of this Agreement.
1. Ownership of Plans
All Plans, drawings, designs, concepts, layouts, graphics, and related documents remain the exclusive intellectual property of Pionarch Design & Construction.
The purchase of a Plan does not transfer ownership, copyright, or any other intellectual property rights to the purchaser.
Pionarch retains all rights, title, and interest in the Plans except for the limited license granted under this Agreement.
2. License Granted
Upon purchase, Pionarch grants the purchaser a limited, non-exclusive, non-transferable license to use the purchased Plans for the construction of one (1) structure at one (1) physical location.
This license allows the purchaser to:
- Download and store the purchased files for personal use.
- Review and provide the Plans to qualified professionals involved in the permitted construction project.
- Use the Plans as a reference for obtaining permits, approvals, and construction.
3. Restrictions on Use
The purchaser may not:
- Build the same Plan more than once without purchasing an additional license.
- Resell, transfer, distribute, or share the Plans with any other person or company.
- Upload, publish, or distribute the Plans online or through any platform.
- Modify, copy, reproduce, or create derivative designs based on the Plans for resale or commercial purposes.
- Claim ownership of the Plans or designs.
- Use the Plans as a template for creating competing designs or products.
Any unauthorized use of the Plans is a violation of this Agreement and may result in legal action.
4. Multiple Builds & Commercial Use
If the purchaser intends to construct multiple structures using the same Plan, use the Plan for a development project, or use the Plan for commercial purposes, additional licensing must be purchased from Pionarch.

5. Modifications & Customization
Purchased Plans may be modified only for the purchaser’s approved construction project.
Customers may request modifications, revisions, or customizations from Pionarch for an additional fee.
Modification services do not transfer ownership of the original design or grant rights to reproduce or resell modified versions.
6. Professional Review & Local Requirements
The purchaser understands that building codes, zoning requirements, permitting procedures, and construction regulations vary by location.
The purchaser is responsible for ensuring that the Plans are reviewed and approved by appropriate professionals and comply with all applicable local requirements.
Additional engineering, permitting documents, or revisions may be required and may involve additional costs.
7. No Guarantee of Permit Approval
Pionarch provides Plans based on the intended design and information available at the time of purchase.
Pionarch does not guarantee that a purchased Plan will receive approval from any specific municipality, building department, homeowners association, or regulatory authority without modifications or additional documentation.
8. Digital Product Agreement
The purchaser acknowledges that the Plans are delivered electronically and that access to digital files is provided after purchase.
Because digital products cannot be returned or recovered after delivery, all sales are final in accordance with Pionarch’s Refund Policy.
9. Violation of Agreement
If the purchaser violates this Agreement, Pionarch reserves the right to pursue available legal remedies, including seeking damages, injunctive relief, and recovery of legal expenses where permitted by law.
10. Governing Law
This Agreement shall be governed by the laws of the Commonwealth of Massachusetts.
Any disputes arising from this Agreement shall be resolved in the appropriate state or federal courts located in Massachusetts.
11. Acceptance of Terms
By purchasing or downloading Plans from Pionarch Design & Construction, the purchaser acknowledges that they have read, understood, and agreed to this Digital Plan Licensing Agreement.
